Scherer-Backed Legislation Ensures Renters Have More Payment Options

DECATUR, Ill. – Tenants will have more options when making rental payments under a new law passed by state Rep Sue Scherer, D-Decatur, prohibiting landlords from requiring electronic payment methods.

“Many people, especially those who are struggling, simply do not have access to bank accounts or other electronic payment methods,” said Scherer. “Not being able to pay your rent because you only have cash can cost you dearly while late fees accumulate and your landlord-tenant relationship deteriorates.”

Scherer sponsored House Bill 1628, which is now law. Scherer’s law will prohibit landlords from requiring tenants to utilize an electronic payment portal or other non-cash payment methods. Beginning next year, the Attorney General will be empowered to pursue violations as a breach of the Consumer Fraud and Deceptive Business Practices Act. The law will only apply to new rental and lease agreements signed after Jan. 1, 2024.

“There’s no good reason that paper money cannot be accepted to pay housing costs,” said Scherer. “Additionally, electronic payment sites often tack on extra fees that cost landlords and tenants alike. I am proud of this new law that will remove a significant burden for renters and lessees across our state.”
