CHICAGO – Following the signing today of Senate Bill 208, the Paid Leave For All Workers Act, by Gov. J.B. Pritzker, state Rep. Sonya M. Harper, D-Chicago, is hailing the new measure.
“This law is great news for working people and their families across Illinois, especially in marginalized and historically disinvested communities,” Harper said. “Giving workers—who, let’s not forget, are also spouses and parents, brothers and sisters, neighbors and caretakers—the flexibility to live their lives without having to choose between income and their other responsibilities is a no-brainer when it comes to promoting equity and fairness throughout our state.”
The new law requires that most workers throughout the state have the ability to earn up to five days of paid leave per year, usable for any reason. Employers cannot require an explanation for why leave is being taken, require workers to find replacements before taking leave, or retaliate against or penalize workers for using their leave. Up to 40 hours of unused leave can be carried over from one year to the next. Employees are paid at their full hourly rate when taking leave, and those who get most of their pay from tips or commissions must be paid at least the full minimum wage. Some other conditions apply, and the full text of the new law is available on ILGA.gov.
“This bill is pro-worker and pro-economy,” Harper said. “Workers who have the flexibility to take care of themselves and their families are an asset to businesses.”
